1. Interpretation
1.1 In these terms and conditions the following words shall have the following meanings:
(a) Delta: Delta Music plc and any connected organisation that actually supplies goods ordered by you and any successor to its business;
(b) www.deltamusic.co.uk: the online retailer in the UK for Delta;
(c) Working day: every day of a calendar year apart from weekends and English statutory and public holidays; and
(d) You/ your: the person ordering the goods under these terms and conditions.
2. Price and Payment
2.1 Delta must receive payment of the whole of the price of the goods that you order before your order can be accepted. Once payment has been received www.deltamusic.co.uk will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form.
2.2 Delta's acceptance of your order brings into existence a legally binding contract.
2.3 The prices payable for goods that you order is as set out in Delta's web site.
2.4 All of the information you give to Delta is private and secure. Delta does not disclose information about its customers. Please see our data protection policy.
3. Availability
Delta will do its best to fulfil your order within the time stated, but it cannot guarantee this in every instance. Delta will inform you of any problems of which it become aware as soon as practicably possible.
4. Delivery
4.1 Delta will deliver the goods ordered by you to the address you give www.deltamusic.co.uk for delivery at the time you make the order.
4.2 Dispatch will be made as soon as possible after your order is accepted and in any event within 7 working days of your order.
4.3 Once payment has been received, you will become the owner of the goods and they will be held at your own risk. Delta will not be liable for their loss or destruction.
5. Returns
5.1 Return of goods must be in their original condition within 30 days of your order for a complete refund. The goods need to be returned together with the delivery note or invoice number and your name and address.
5.2 You must contact Delta for authorisation to return goods Any goods returned without authorisation or which are not in the condition set out above will be rejected and returned to you at your cost.
5.3 If the goods Delta delivers are not what you ordered, are damaged, defective or the delivery is an incorrect quantity you must notify Delta in writing (at the Delta contact address) of the problem within 7 days of receiving the order.
5.4 If you do not receive goods ordered by you within 30 working days of the date on which you ordered them you must notify Delta in writing at the Delta contact address.
5.5 If you notify a problem to Delta under this condition, Delta will, at your option, either:
(a) Make good any shortage or non-delivery; or
(b) Replace any goods that are damaged or defective; or
(c) Refund to you the amount paid for the goods.
5.6 Delta shall not be liable for any indirect loss or expense (including loss of profit) arising out of a breach of its obligations unless you have previously given notice that such loss is likely to be incurred in the event of breach.
5.7 Nothing in this contract is, however intended to limit your statutory rights nor in any way to exclude or limit Delta's liability to you for any death or personal injury resulting from its negligence.
6. Force Majeure
Delta reserves the right to defer the date of delivery or to cancel the contract if it is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, lock-outs, strikes or other labour disputes (whether or not relating to Delta's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials.
7. General
7.1 If any part of these conditions is unenforceable (including any provision in which Delta excludes its liability to you) the enforceability of any other part of these conditions will not be affected.
7.2 This contract shall be governed by English Law and the parties submit to the exclusive jurisdiction of the English courts
